Terms

Article 1 (Scope of Application)

Accommodation contracts and related agreements concluded between the hotel and guests shall be governed by these terms and conditions, and any matters not stipulated in these terms and conditions shall be governed by laws, regulations, or generally accepted practices.
If the Hotel enters into a special agreement with a Guest, provided that it does not violate laws, regulations, or customary practices, the special agreement shall take precedence over the provisions of the preceding paragraph.

Article 2 (Application for Accommodation Contract)

Anyone who wishes to apply for an accommodation contract with the Hotel must provide the Hotel with the following particulars:

Article 3 (Conclusion of Accommodation Contracts, etc.)

An accommodation contract will be deemed to have been concluded when the hotel accepts the application as set forth in the preceding article. However, this does not apply if the hotel proves that it did not accept the application.
When an accommodation contract has been concluded in accordance with the provisions of the preceding paragraph, an application fee set by the hotel, limited to the basic accommodation fee for the period of stay (if it exceeds three days, three days), will be required to be paid by the date specified by the hotel.
The application fee shall first be applied to the accommodation fee to be paid in full by the guest, and in the event that a situation arises to which the provisions of Articles 6 and 18 apply, it shall be applied in the order of penalty charges and compensation, and the remainder, if any, shall be refunded at the time of payment of the accommodation fee as provided for in Article 12.
If the application fee set forth in paragraph 2 is not paid by the date specified by the hotel in accordance with the provisions of the same paragraph, the accommodation contract will become invalid. However, this only applies if the hotel notifies the guest to that effect when specifying the due date for payment of the application fee.

Article 4 (Special agreement waiving the application fee)

Notwithstanding the provisions of Article 2, Paragraph 2, the Hotel may enter into a special agreement waiving the application fee stipulated in the same paragraph after the contract has been concluded.
If, when accepting an application for an Accommodation Contract, the Hotel does not request payment of the application fee as stipulated in Paragraph 2 of the preceding Article or does not specify a due date for payment of the application fee, the application shall be treated as having accepted the special provisions of the preceding Paragraph.

  8. (8) When a Guest seeking accommodation repeatedly makes requests to the Hotel that are stipulated in Article 5-6 of the Regulations for Enforcement of the Inns and Hotels Act, which are deemed to impose an excessive burden on the Hotel and Hotel Business Act and which are likely to significantly impede the Hotel’s provision of accommodation-related services to other Guests. However, in the event that the hotel has accepted a special agreement as set forth in Article 4, Paragraph 1, this shall only apply if the guest has been notified of the obligation to pay a penalty in the event that the guest cancels the accommodation contract when accepting the special agreement.
If the guest does not arrive by 10:00 p.m. on the day of the stay without contacting the hotel (or by two hours after the expected arrival time if the guest has specified that time in advance), the hotel may consider the accommodation contract to have been cancelled by the guest.
